Welcome to LeadLift

These Terms of Service ("Terms") govern your use of the LeadLift website at https://leadlift.fit ("Website") and the lead management services we provide. By creating an account, making a purchase, or using our services, you agree to these Terms. If you do not agree, please do not use the Website or our services.

1. Description of the Service

LeadLift is a lead management tool for personal trainers and fitness professionals. It allows you to store leads, set follow-up dates, add notes, and access your data from a private dashboard. Access to the dashboard and full features requires a one-time payment.

2. Account and Access

You must create an account (e.g. via Google or email) to use the service. You are responsible for keeping your login details secure and for all activity under your account. You must provide accurate information. We may suspend or terminate access if we reasonably believe you have breached these Terms.

3. Payment and Refunds

Access to the LeadLift dashboard is granted after a one-time payment. Payment is processed securely by our payment provider. We do not store your full card details on our servers.

You may request a full refund within 7 days of your purchase. To request a refund, contact us by email at the address given at the end of these Terms. Refunds are processed in accordance with the Consumer Rights Act 2015 and our refund policy.

4. Your Data and Acceptable Use

You retain ownership of the lead data you enter (names, emails, notes, etc.). We use it only to provide and improve the service. You must not use the service for any illegal purpose, to send spam, or to collect or process personal data in a way that breaches data protection law. You are responsible for ensuring your use of lead data (e.g. for marketing) complies with applicable law, including UK GDPR and the Privacy and Electronic Communications Regulations.

5. Privacy

Our collection and use of personal data (including your account details and payment information) is described in our Privacy Policy. Please read it at https://leadlift.fit/privacy-policy. By using the service you also agree to the practices described there where they apply.

6. Intellectual Property

The LeadLift name, logo, website design, and software are owned by us or our licensors. We grant you a limited right to use the service for your own business in accordance with these Terms. You may not copy, resell, or reverse-engineer the service.

7. Availability and Changes to the Service

We aim to keep the service available but do not guarantee uninterrupted access. We may update, suspend, or discontinue features with reasonable notice where possible. We will not be liable for any unavailability except where required by law.

8. Limitation of Liability

The service is provided "as is". We do not exclude or limit our liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be excluded under the laws of Scotland. Otherwise, our total liability to you for any claim arising from these Terms or the service shall not exceed the amount you paid us in the 12 months before the claim. We are not liable for any indirect, consequential, or special loss (such as loss of profit or data) arising from your use of the service.

9. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top will be revised when we do. Continued use of the service after changes means you accept the updated Terms. We will notify you of significant changes by email where we have your address.

10. Governing Law

These Terms are governed by the laws of Scotland. Any dispute shall be subject to the exclusive jurisdiction of the courts of Scotland.
